Terms of Use

1.1.           We shall solely own all intellectual property rights (including the use of trademarks). You are permitted only to use the material provided on our Service as expressly authorised by us or our licensors. Our rights are protected by UK, European, and International intellectual property laws, including those for the protection of copyrights, trademarks, and database rights. Misuse of our Service may incur civil liability or attract criminal sanctions.

1.2.           This Agreement provides only a limited licence to access and use this Service in accordance with the terms of this Agreement. Accordingly, you hereby agree that such use transfers no ownership or intellectual property interest or title in and to content available on this Service or any other intellectual property to you or anyone else in connection with your use of this Service.

Proprietary Rights

2.1           Thank you for choosing to subscribe to our Advanced Course Monthly Group service (referenced herein as the “Service”), these Terms of Use (referenced herein as the “Agreement”) will apply to all users of this Service. This Agreement (together with the documents referred to in it) tells you the terms of use on which you may make use of this Service.

2.2           You should read this Agreement carefully because it governs your access to, and use of, the Service, the integral functionality it provides and any related services. The Service conveys access to a private and separate online portal and telegram chat group for subscribers to access and securely discuss a range of specialist content and materials in return for a payment of a monthly subscription.

2.3           By subscribing to, and using, the Service, you (referenced herein with “you” or with “your”) are entering into a legal agreement with Bsappsfx Ltd (referenced herein as “we”, “us” or ‘our’), consisting of this Agreement, our standard website Terms and Conditions, and our Privacy Policy. You acknowledge that you have read this Agreement, that you understand it and its terms and conditions and that you agree to be bound legally by it. If you do not agree with any of the terms and conditions outlined in this Agreement, you are not granted permission to access or use the Service.

Restrictions on Use

3.1           you are hereby prohibited from using the Service in any manner that is not explicitly and unambiguously authorised by this Agreement.

3.2           Subscribers to the Service are authorised to access a private and separate online portal and telegram chat group where materials including setups, images, videos, and resources will be posted. Subscribers will be permitted to access and discuss the specialist content and materials within the portal and the telegram chat group provided for this Service.

3.3           All materials provided as part of the Service are to be treated in the strictest confidence. Subscribers must not share or discuss any materials provided as part of the Service outside of the Service unless authorised in writing by us as the service provider. This restriction includes, but is not limited to, any reference to specific terminology used within the Service, reproduction of any provided content including screenshots of such content, or reproduction of any conversations within the Service’s telegram chat group.

3.4          For the avoidance of doubt, these restrictions prohibit the reproduction, dissemination or discussion of any content provided by the Service on any other telegram groups provided by us that are not part of the Service or with any user of our other training services who is not a subscriber to the Service.

3.5           Any violation of these restrictions of use will result in the immediate cancellation of your subscription to the Service, the removal of all your rights to use the Service, and the cancellation of all other subscriptions and course purchases taken out with us.

Fee & Subscription

4.1.          Access to the Service is made available in return for the payment of a monthly recurring fee at the rate advertised on the website. Monthly fees must be paid in full in advance using an accepted payment method. Any failure to make payment in a timely manner will result in the cancellation of the subscription and removal of access rights to the Service until such time that payments resume and any balance owing is paid in full.

4.2.           We accept payment via PayPal and most major credit and debit cards. You must only use a card if you are the named cardholder on the card that you use to make payment and, by placing an order, you confirm that you are the authorised cardholder.

4.3.           Your card provider may add a charge for using your card on our website, and we will not be liable for any such charges. Please refer to the terms and conditions provided by your card provider before submitting your payment details.

4.4.           Once you have confirmed that you wish to purchase paid membership and have received confirmation that the paid membership has started, you will lose any cancellation rights which you may have had under the Consumer Protection (Distance Selling) Regulation 2000. This does not affect your other statutory rights, and you may still cancel the paid membership at any time in accordance with this Agreement. Any approved cancellation will take effect at the date when the next payment was due, and no refund will be made.

• You may cancel your subscription at any time by providing us with a minimum of seven days written notice. It is your responsibility to ensure that any recurring payment mechanism is cancelled once we approve the cancellation of the subscription.
• We reserve the right to change our fees for the Service at any time, upon notice to you if such change may affect your existing subscription. All Fees shall be deemed to be in GBP and inclusive of taxes, except when specifically stated otherwise by us.

Refund Policy

Due to the fact that payment of the subscription fee for access to the Service allows full immediate access to the content provided for the Service, we cannot issue refunds due to the nature of the transaction.

Term and Termination

• This Agreement will take effect when you subscribe to the Service. You may cease use of the Service at any time.
• This Agreement will automatically terminate if:
  1. You fail to comply with any of its terms and conditions;
  2. Your subscription to the Service is cancelled for any reason.

Termination will be effective without notice. In addition, we may at our sole discretion cancel your subscription and terminate this Agreement upon notice to you for any or no reason. Upon termination of this Agreement, any and all rights to use the Service shall immediately cease and you must promptly delete or destroy all copies of the materials provided by the Service in your possession or control.

Subscriber Obligations

7.1.          By subscribing to and using the Service, you covenant that you will abide by all applicable national and local laws and regulations with respect to your use of the Service.
7.2.           If you choose to subscribe to the Service, you must treat any account login credentials as confidential information, and you must not disclose these details to anyone else. You are responsible for maintaining the confidentiality of your account and to the extent permitted by law, you agree to accept full responsibility for all activities that occur under your account.

7.3.           You must inform us immediately and undertake to us if you have any reason to believe that your account login credentials have become known to anyone else, or are being, or are likely to be used in an unauthorised or illegal manner.

7.4.           We reserve the right to terminate your subscription and remove your access to the Service if you are in breach of applicable laws, this Agreement, or any other applicable terms and conditions, guidelines, or policies.
